LIMITED LIFETIME PRODUCT, WORKMANSHIP, AND SERVICING WARRANTY

Limited Warranty for Manufacturing Defects. During the period in which the Owner owns his or her home, if all or any part of a product is found to have a manufacturing defect, Rhino Roofing will arrange to have the defective portion of the product repaired or, at its sole option, provide the Owner with a replacement product and reimburse the Owner for the full reasonable cost of labor. The cost of labor to remove the product and dispose of the existing product is not included in this warranty. Home owners must be enrolled in our roof maintenance program to qualify for this lifetime warranty.
Limited Warranty for Misapplication. During the period in which the Owner owns his or her home, if all or any part of a product is found to have application errors, Rhino Roofing will arrange to have the defective portion of the product repaired or, at its sole option, provide the Owner with a replacement product and reimburse the Owner for the full reasonable cost of labor. The cost of labor to remove the product and dispose of the existing product is not included in this warranty.
How to Obtain Warranty Service. To submit a claim, the Owner must send a notice of claim in writing together with proof that this warranty was registered to the Owner with Rhino Roofing at P,O Box 523 Allendale MI 49401. Claims must be submitted to Rhino Roofing within thirty (30) days after discovery of the claimed defect. Rhino Roofing may require the Owner to submit, at the Owner’s expense, sample products for testing and photographs. Rhino Roofing will then schedule an appointment to inspect the premises and the warranty claim within a reasonable period of time after having received the claim. If after inspection, Rhino Roofing determines that a valid claim exists under one or more of the warranties, Rhino Roofing will repair, re-install, replace, or refund the purchase price of the failing Rhino Roofing product or service, at Rhino Roofing’s option. If Rhino Roofing determines to replace any or all Rhino Roofing products, and if the Rhino Roofing product as originally installed is no longer available, Rhino Roofing shall have the right to substitute a Rhino Roofing product designated by Rhino Roofing to be of equal quality. Replacement of a product or component does not renew the warranty period. Minor color variations may exist between replacement product and the originally installed product and are not indicative of a defective product. If, at Rhino Roofing’s option, a purchase price refund is conveyed to the Owner, then all warranties are terminated, and repair, replacement, or removal of Rhino Roofing products shall become the sole responsibility of the Owner. If the Rhino Roofing inspection determines that the claim is not covered by the warranty, the Owner agrees to pay Rhino Roofing a $250 fee to offset Rhino Roofing’s cost of inspecting the Owner’s claim. This warranty will be cancelled if the Owner fails to pay this fee within 30 days of receipt of an invoice for it. No warranties are valid unless and until the Owner has made full payment under the original Rhino Roofing sales agreement and all addenda thereto. Non-warranty calls for repair or adjustment may result in a service charge. This warranty will not take effect unless all eligibility requirements have been satisfied and Rhino Roofing has been paid in full.
What Is Not Covered. These warranties are granted by Rhino Roofing to the Owner only and only products purchased from and installed by Rhino Roofing are covered by these warranties. All warranties terminate immediately upon the transfer of home ownership, unless the terms of transfer are met (see “How to Transfer These Warranties” below). All warranties assume normal and reasonable use of Rhino Roofing products. Minor color or textural variations from lot-to-lot of product are not product or installation defects. These warranties do not cover 1) any damage to the Owner’s product from anything other than an inherent manufacturing defect in the product, their misapplication or their failure to seal, or the misapplication of flashings, such as inadequate attic ventilation or application of shingles/membrane directly to insulation or to an insulated deck unless prior written authorization is obtained by Rhino Roofing (ventilation must meet at least FHA Minimum Property Standards); 2) any damage to the Owner’s product resulting from causes beyond normal wear and tear such as the corrosive effects of salt air and chemical pollutants, normal fading, deterioration of caulking compounds, fire, flood, lightning, high winds, windblown objects, earthquake, hurricanes, ice dams, icicles and/or ice storms, atmospheric conditions or weather of catastrophic nature as defined by the United States National Weather Service, other acts of God, impact of foreign objects or traffic on the product, improper storage or handling of any products, and any weather event that a homeowners insurance policy will cover; 3) any condition (e.g. base flashing height or lack of counter-flashings) that is not in accordance with NRCA standards; 4) conditions that prevent positive drainage or result from ponding water,; 5) damage caused by settlement, condensation, or chemical attack including exposure to oil or grease; 6) shading or variations in the color of the Owner’s shingles or contamination caused by fungus, algae, or other contaminants; 7) changes to the color of the wood or exterior aluminum on skylights caused by ultraviolet rays; 8) damage caused by products not supplied Rhino Roofing; 9) improperly designed or installed gutter or downspout systems (if not installed by Rhino Roofing); 10) damage to the interior or exterior of any building, including, but not limited to, mold growth; 11) damage to or caused by rooftop air conditioning units (and their flashing) pipe works, brace works, rooftop satellite dishes or other radio/TV devices, counter-flashings, or flashings other than those specifically included above. The Owner understands and acknowledges that fogging or condensation on skylights resulting from interior building humidity or indoor/outdoor temperature differences is a result of environmental conditions, not a manufacturing defect. 11) Ice Dams – any interior or exteriors damage caused by the ice buildup on the roof.
What Voids These Warranties. Not scheduling and receiving a service inspection within 365 days of the most recent inspection. removal, repair, adjustment, tampering, or re-installation of any Rhino Roofing products or components by other than Rhino Roofing voids any and warranties within this document, and Rhino Roofing expressly disclaims any liability for any costs, defects, or damages with respect to such actions.
Remedies and Rights. These warranties of Rhino Roofing’s products and services are the only expressed warranties provided by Rhino Roofing. No employee, representative, agent, nor any other person, has authority to assume or incur on behalf of Rhino Roofing any obligation, liability, or responsibility in place of or in addition to these warranties. IN NO EVENT SHALL THE DURATION OF ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE BE LONGER THAN THE DURATION OF OWNERSHIP AND OCCUPATION BY THE ORIGINAL OWNER (OR SECONDARY HOMEOWNER AS PER THE BELOW STATED CONDITIONS FOR TRANSFER) OF THE HOME ON WHICH RHINO ROOFING PRODUCT IS INSTALLED. EXCEPT FOR THE WARRANTY PROVIDED HEREIN, RHINO ROOFING MAKES NO WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. RHINO ROOFING’S LIABILITY TO THE OWNER (OR ANY SECONDARY HOMEOWNER) UNDER THIS DOCUMENT IS LIMITED TO THE AMOUNTS RECEIVED BY RHINO ROOFING FOR SERVICES RENDERED UNDER THE SALES AGREEMENT WITH THE OWNER. SOME STATES DO NOT PERMIT ANY LIMITATION ON THE LENGTH OF AN IMPLIED WARRANTY, AND THEREFORE THE IMMEDIATELY PRECEDING SENTENCE MAY NOT APPLY. IN NO EVENT SHALL RHINO ROOFING BE OBLIGATED OR LIABLE FOR INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND FOR THE BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OF RHINO ROOFING PRODUCT OR SERVICES. SOME STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, AND THEREFORE SOME OR ALL OF THE IMMEDIATELY PRECEDING SENTENCE MAY NOT APPLY. THESE WARRANTIES PROVIDE SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.
How to Transfer These Warranties. Subject to the other terms and conditions contained in this document, these warranties are transferable once by the Owner to a Second Owner and the Second Owner shall be entitled to all benefits contained in this warranty. In order for the transfer of this warranty to the Second Owner to be valid, the Second Owner must notify Rhino Roofing in writing within thirty (30) days after the property transfer has occurred and pay one-time transfer fee of $1,250 or $85 per square foot, whichever is greater. This fee must be received within the 30 days of property transfer as well. Failure to meet these requirements will void this warranty.
